Wrongful Death Lawsuit Regarding Kane County Collision

There has been a wrongful death lawsuit filed regarding a fatal two-vehicle accident that happened in Kane County.  The accident, which happened on March 29, 2016, involved a “head-on collision” between a Ford F150 pickup truck and Chevy Trailblazer.  The collision (which was initially summarized in the March 29, 2016 post titled “Fatal Kane County ‘Head-On Collision’“) occurred on Route 31, north of Mooseheart Road, after the Ford F150 crossed the road’s centerline and went into the opposite lane, thereby striking the oncoming Chevy Trailblazer.

The driver of the Chevy Trailblazer, identified as Jose F. Quitl, 21, of Aurora, died at the accident scene.

The driver of the Ford F150 was identified as Brandon D. Haller, 24, of Elburn.  He was taken to Delnor Hospital for treatment of accident injuries that were considered to be non-life-threatening in nature.

An excerpt from the September 22, 2016 Daily Herald article titled “Lawsuit argues distracted driving, negligence in March fatal crash near Mooseheart“:

Haller was cited for improper lane use in the crash, which occurred at about 10:17 a.m. on Route 31, just north of Mooseheart Road, according to court records.

The lawsuit, filed on behalf of Quitl’s widow, Diana Quitl Gonzalez, and their two children, argues Haller was negligent, did not take proper precautions and may have been distracted, leading him to cross the road’s centerline and into the southbound lanes, thus causing the crash.
