$775,000 Injury Lawsuit Settlement For Injured Pedestrian

A $775,000 injury lawsuit settlement has recently been attained by the Elman Law Group, a personal injury and wrongful death law firm based in Chicago. The underlying pedestrian accident injury occurred in Chicago and involved a woman who was hit by a vehicle.

The case involved an 80-year-old woman, Georgina Melendez, who was struck by a vehicle on March 11, 2017.  The accident occurred at 8:00 p.m. at the corner of Ashland and Leland.

According to the police report, the defendant and two witnesses both indicated that at the time of the accident the intersection was dark, and the plaintiff was wearing dark, non-contrasting clothing.

Claimed harm to Georgina Melendez included a dislocated left knee with a post-operative blood clot.  Specifically, the knee injury was an acute complete ACL rupture, with associated slight anterior translation of the proximal tibia relative to the distal femur.

After the operation, the orthopedic surgeon indicated that Georgina Melendez made a nearly full and complete recovery.

Medical bills related to the initial knee surgery were approximately $220,000.

The defendant was insured by State Farm Insurance.

There was a fatal single-vehicle collision in Kane County on Thursday morning, April 7, 2016.

The accident happened in unincorporated Hampshire Township.  The accident involved a Honda CRV that was traveling westbound on Lenschow Road.  For a currently undisclosed reason, the vehicle ran into a tree after leaving the roadway on the north side of Lenschow Road, 1/2 mile west of French Road.

Ronald Suitts, 64, of the 900 block of South Street in Elgin, the sole occupant of a 2001 Honda CRV, was extricated from the vehicle and taken to Presence Saint Joseph Hospital in Elgin where he later died, the sheriff’s office said.

The accident remains under investigation.

Fatal Pickup Truck Accident In Aurora

There was a fatal collision in which a pickup truck struck and tree, and then a house, in Aurora.

According to a preliminary investigation by the Aurora Police Department, the accident happened shortly after midnight Monday night (crash on March 21, 2016) as a teenager was driving southbound in the 300 block of Woodlawn Avenue.

At that time, the pickup truck left the roadway and then struck a tree.  As it did so, the pickup truck flipped and the driver was ejected.  The pickup truck struck then struck a house.

After being ejected, the driver had the pickup truck land on top of him.

The driver was identified as Bryan J. Westcott Jr., 18.  He was pronounced dead at the accident scene.

An excerpt from the Beacon-News article of March 21, 2016, titled “Teen dies in Aurora Crash“:

No signs of drugs or alcohol were present at the scene, and police are trying to determine the cause of the accident in an ongoing investigation. An autopsy is pending at the Kane County Coroner’s Office in Geneva. Police are asking anyone who may have witnessed the crash to call traffic investigators at 630-256-5330.

There has been a second Illinois lawsuit filed regarding a fatal Kane County “head-on” collision that happened in Campton Hills, Illinois on December 1, 2012.

This second lawsuit has been filed by Erin Pazin, who was a passenger in the vehicle that was struck during the collision.  The lawsuit is filed against the estate of Jennifer Liston, who drove the car that struck the vehicle Pazin was an occupant of, and Bruce Greenberg of Wheaton.  The lawsuit seeks unspecified damages.

Pazin argues that Liston was negligent in operating the 2003 Nissan Altima that she drove in the crash. Greenberg was the owner of the Altima, and Pazin argues that he negligently entrusted Liston with his car. The complaint also states that Greenberg observed Liston consume alcohol before the Dec. 1 crash.

ATV Collides With Motorcycle In Kane County, Illinois

Off-Road Collision In Kane County

There was a Kane County accident today involving an off-road collision between an ATV and motorcycle.  Two 15-year-old boys sustained serious injuries because of the collision, and were airlifted from the scene of the accident.

According to the Kane County Sheriff’s Office the accident happened at approximately 2:25 p.m., near Lily Lake.

According to preliminary information, the three boys were riding off-road vehicles in the area of 45W740 Read Road when one of the boys, riding a motorcycle, apparently stopped for an unknown reason.  A collision ensued as the boy was struck from behind by another boy who was riding an ATV.

Both of these boys sustained head injuries and were flown to hospitals.

Fatal Car Accident In Elgin, Illinois

Fatal Car Accident In Kane County

There was a fatal car accident in Elgin, Illinois on Tuesday evening (May 27, 2014) that happened as a parolee fled police in his car.

This fatal Kane County accident happened at approximately 5:08 p.m., after the parolee fled from Elgin Police as they attempted to stop him at Dundee and Jefferson Avenues.  

The parolee was identified as Steven “Stevie” T. Luellen, 34, of Elgin.  Elgin Police had attempted to stop him on an Illinois Department of Corrections warrant.

As Luellen attempted to elude Elgin Police, he “ran a stop sign” at Jefferson and Liberty Street, and his car collided with a Mazda MPV traveling northbound on Liberty Street.  

The MPV was driven by Miguel A. Tellez, 35, of Carpentersville.  He was taken to Advocate Sherman Hospital were he was pronounced dead.

Luellen and a passenger in his car were both hospitalized.

According to Elgin Police, they did not chase the vehicle driven by Luellen.
