Wrongful Death Suit Filed Over Fatal Crash Along Burr Road

Kane County Lawsuit

A wrongful death suit has been filed with regard to a fatal October 2017 car crash along Burr Road. This October 2017 car crash was initially summarized in the October 6, 2017 post titled “Fatal Car Crash On Burr Road Near St. Charles” with additional details seen in the December 11, 2018 post titled “Drunk Driver Allegedly Caused Fatal Burr Road Crash.”

The wrongful death suit is discussed in a June 5, 2018 Daily Herald article titled “Family of Geneva teen killed in fiery DUI crash sues friend who was driving.”

The article discusses a wrongful death suit that has been filed by the parents of the decedent, Nicholas D. Hanson, 19, of Geneva. The driver of the Jeep Cherokee that crashed, of which Hanson was a passenger, was Raphael P. Peruzza, 20, of Geneva. He is one of the defendants in the wrongful death lawsuit.

Notable excerpts from the article include:

Peruzza, of the 2000 block of Eldorado Drive, is charged with aggravated DUI, reckless homicide, driving in the wrong lane and driving too fast for conditions in the early morning crash, according to Kane County court records.

also:

The suit argues Peruzza was negligent, speeding and didn’t slow down while heading south on Burr Road near Dean Street before leaving the roadway and hitting a tree.

Although Peruzza, who was 19 at that time, is accused of having a blood-alcohol concentration of .08 or above in the crash, the suit does not cite impairment or alcohol consumption as a reason for negligence.

This site’s “Wrongful Death Lawsuits Stemming From Kane County Accidents” discusses various aspects of lawsuits in which one person dies because of the negligence or intentional actions of another person or party.

On this site, the dangers of speeding is discussed on the “Speed As A Cause Of Accidents Including Those Causing Serious Injury” page. As seen on that page, driving at excessive speed not only increases the possibility of a crash, but also any injuries stemming from such a crash are more likely to be serious in nature if the vehicle has been driven at excessive speed.

Additional Details Regarding Wrongful Death Suits

Additional details regarding wrongful death lawsuits, including the wrongful death lawsuit regarding the death of Nicholas D. Hanson, can be seen in the sources mentioned above.
